RAFFLE RULES
BY PARTICIPATING, entrants agree to be bound by these Official Rules and by the decisions of the Xtreme Couture GI Foundation, which shall be binding and final as to all matters related to each Raffle. The Official Rules should be read before ticket purchase.
SPONSOR:
The sponsor of the Raffle is the Xtreme Couture GI Foundation, a 501(c)(3) non-profit charitable organization. The address at which the Xtreme Couture GI Foundation may be contacted is: 4055 West Sunset Road, Las Vegas, NV 89118. This Raffle is conducted pursuant to Nevada law, and is void outside of Nevada.
RAFFLE DATE AND PERIOD; HOW TO ENTER:
Xtreme Couture GI Foundation will conduct one (1) Raffle during the designated event. Raffle tickets will be sold in-person at the venue as well as via mobile device. Ticket sales will cease at a designated time, with the exact time to be determined at the sole discretion of the Xtreme Couture GI Foundation.
ELIGIBILITY TO ENTER:
While available, Raffle tickets may be purchased only by persons 18 years or older in accordance with these Official Rules. Purchased Raffle tickets are only valid for the date on which the Raffle ticket was purchased.
The following persons are NOT ELIGIBLE to participate in the Raffle or to win any Prize: employees, officers, directors, shareholders and members of Xtreme Couture GI Foundation and/or its event partners and affiliates (each an "Ineligible Party"), and their Immediate Family Members and members of their same household (whether legally related or not). "Immediate family members" means a spouse, parent, legal guardian, grandparent, sibling, child and grandchild of an Ineligible Party.
PURCHASING RAFFLE TICKETS:
While supplies last, Raffle tickets will be sold as described below. There is no limit to the number of Raffle tickets an eligible individual may purchase.
Ticket Price: Two for $5.00, Six for $10.00, Fifteen for $20.00, Fifty for $50.00, and One Hundred and Twenty Five for $100.00.
Xtreme Couture GI Foundation reserves the right to offer promotional pricing, such as early bird pricing where existing price points will offer bonus tickets when purchased before a certain time. For any events featuring promotional pricing, the Xtreme Couture GI Foundation will announce said promotions through Raffle Sales Representatives, the raffle webpage, and the online ticket purchase portal.
No discounts or complementary tickets will be given. Raffle tickets will be available for purchase in person by eligible persons.
NUMBER OF RAFFLE TICKETS:
There is no minimum and no maximum number of tickets that must be sold.
ODDS:
The odds of winning the Prize depend on the number of valid tickets sold.
PRIZE/PAYMENT:
The Raffle prize consists of and is limited to a cash prize equal to fifty-percent (50%) of the gross Raffle ticket sales revenue. Gross Raffle ticket sales shall be as determined by Xtreme Couture GI Foundation in its sole discretion, and is calculated as gross ticket sales revenue less reasonable sums expended for prizes, local license fees, and other reasonable operating expenses incurred as a result of operating the Raffle. All net proceeds of each Raffle will benefit the Xtreme Couture GI Foundation and the programs and charitable donations that Xtreme Couture GI Foundation supports.
If the winner is present at the event and the cash prize is less than $1,000, the prize will be awarded in cash at the event. If the winner is not present or the prize amount is $1,000 or more, a check for the prize amount—net of any required withholding or taxes under applicable federal, state, or local laws—will be mailed to the winner within forty-five (45) days of the drawing date. Issuance of the prize is contingent upon verification of the winning raffle ticket and the winner's compliance with all terms and conditions set forth in these Official Rules.
Winner is solely responsible for any and all costs, fees, additional taxes, or expenses associated with prize award, receipt and use. If applicable, prize winner will be issued an IRS Form 1099 for the amount of the prize.
TRANSFER OF RAFFLE ENTRIES:
Persons who purchase Raffle tickets may opt to give away their raffle tickets but doing so gives up any claim they might otherwise have to the Prize. Purchasers may not resell tickets or knowingly give tickets to others for resale. Violated tickets will be void and persons will be disqualified.
DRAWING:
Each Potential Winner will be selected in a random drawing from eligible Entries received. The potential winner need not be present to win. The Drawing will be held during the designated event. If delayed, it will be held within a reasonable time thereafter. The winning ticket number will be posted on the official Xtreme Couture GI Foundation raffle webpage within 24 hours and remain for 30 calendar days. The owner of the winning ticket has 30 days to claim the Prize.
DETERMINATION OF OFFICIAL WINNER(S):
Xtreme Couture GI Foundation shall have the sole discretion to determine the official winner. The winner must meet eligibility requirements, have their entry verified, and submit all required documents including a tax form and liability/publicity release. If these conditions are not met, the prize will be forfeited.
Xtreme Couture GI Foundation will presume that the individual holding the winning ticket is the lawful winner unless proven otherwise. In the unlikely event that two identical winning numbers are issued, the earliest ticket purchase record will be the valid one.
GENERAL CONDITIONS:
Xtreme Couture GI Foundation is not responsible for lost, stolen, altered, illegible, or tampered tickets; delayed payments; or any errors related to the administration or outcome of the raffle. In case of a compromising event (e.g., tampering or fraud), Xtreme Couture GI Foundation may suspend or terminate the raffle and draw a winner from all eligible entries prior to the event.
All entry purchases are final, and no refunds will be issued. Xtreme Couture GI Foundation may disqualify any entrant who tampers with the raffle or acts disruptively.
RELEASE OF LIABILITY:
By entering, participants release and agree to hold harmless the Xtreme Couture GI Foundation, its affiliates, sponsors, agents, representatives, employees, and partners (collectively "Released Parties") from any claims arising from participation or prize use.
LIMITATION OF LIABILITY:
A participant's sole remedy for any dispute with a Released Party is a refund of the Raffle ticket purchase price. Released Parties shall not be liable for any consequential damages.
TRADEMARKS:
All trademarks are property of their respective owners.
DISPUTES; SEVERABILITY:
Disputes must be resolved individually in Nevada courts. Claims are limited to out-of-pocket costs. The Official Rules are governed by Nevada law. If any provision is invalid, the rest remain enforceable.
